After taking the lives of 3 family members on Christmas Day in 2007, David Belniak, 38, wants to twist the blade a little deeper and lob a lawsuit at the estate of the driver who died from injuries sustained in this senseless tragedy.
Belniak had alcohol, Xanax and evidence of cocaine in his system and failed to brake when he slammed into the back of a truck driven by Ray McWilliams and several family members. FHP estimates Belniak's speed between 75-82 mph going through the red light on U.S. 19 at Little Road in Spring Hill, on a stretch of road where the speed limit is 45 mph.
Belniak is a true master of automobile related disaster. He has two previous DUI convictions under his belt. In 2003, New Port Richey cops found a gallon of the "date rape" drug, GHB, in his vehicle. He served 17 months in prison for drug trafficking.
Back in 1994, Belniak creamed a pedestrian on U.S. 19 near Fivay Road. Although the woman passed away from her injuries, he was not charged.
The survivors of his latest victims are appalled at his frivolous lawsuit, claiming McWilliams was actually at fault for the accident. Belniak's lawyer, who also happens to be his sister, states their $15,000 lawsuit is an attempt to get both sides of the story heard in small court.
The victim's families are suing Belniak for their pain and suffering. And rightfully so. During the trial for the death of the three family members, he didn't even offer an apology. Nor did he show emotion of any kind. Something that weighs heavy with the jury.
Hopefully, he is the victim of brutal sexual assaults in prison for actions. This family has suffered enough. Someone lost a mother, a father, a sister, and a brother. David Belniak is a cancer to society and has done nothing but bring pain and misery to this family, and other families he damaged over his lifetime.
Let's not forget, he sold GHB in the Tampa area, so who knows how many young women were victimized due to this creep.
Hopefully, the judge will punish Belniak to the full extent of the law and let this family put this terrible event behind them once and for all.
